Luxpro Launches Countersuit Against Apple for Knockoff Lost Sales

Luxpro_EZ_Square_MP3_Player_.jpgLuxpro is a Taiwanese electronics company that is manufacturing a knockoff to the Apple iPod shuffle, called the "Super Shuffle" initially, but they changed the name of the MP3 player to the Tangent to avoid legal action. It didn't work and Apple sued Luxpro in Shihlin District Court of Taiwan for the copyright infringement and won. Luxpro was ordered to desist from manufacturing, advertising, and selling the product. Then Luxpro appealed the ruling and won the appeal. Apple appealed to the Taiwan Supreme Court and they upheld the appeals court ruling in favor of Luxpro. Apple also lost a complaint made with the Taiwan Fair Trade Commission.

Now Luxpro has been emboldened to file a counter suit Apple for $100 million in lost sales. Luxpro alleges that Apple threatened to pull the iPods from any retail outlet that carried the Luxpro knockoff. Luxpro claims that the Tangent is substantially different than the iPod Shuffle, but from a distance, most would not be able to tell the difference.
